The only thing we as law firm administrators and HR can predict is that things will remain unpredictable. The challenges we have faced are complex, and many are here to stay.  One constant, however, is our need to manage our employees’ performance, whether they are working in-person or remotely.

Proper documentation and empathetic management are crucial in navigating employee relations issues.  When it comes to discrimination, retaliation, and other wrongful discharge claims, legal liability often hinges on documentation. But it’s not enough simply to document, document, document. Poor documentation is as dangerous as no documentation.  The key is not only what you say but also how and when you say it.

This session focuses on the human resources, employee relations, and legal issues implicated in disciplinary documentation, while also examining how growing attention to empathy and mental health awareness can influence performance management.

Key Takeaways:

  • Identify the elements of effective performance documentation.

  • Avoid common pitfalls that can undermine legal protections.

  • Incorporate empathy into performance management conversations.

  • Understand the impact of mental health awareness on documentation practices.

Empathy is paramount and has never been more important than it is today. Don’t miss your chance to sharpen your ability to navigate the intersection of empathy and effective documentation—protecting both your people and your organization.
